Terms of Use

By downloading, installing, or using Dartform (the "Software"), you agree to be bound by these Terms of Use ("Terms"). If you are accepting on behalf of a company or organization, you represent that you have the authority to bind that entity.

If you do not agree to these Terms, do not install or use the Software. Continued use of the Software after any update to these Terms constitutes your acceptance of the revised Terms.

Subject to your compliance with these Terms, and upon payment of the applicable one-time license fee, Mobterest Studio grants you a limited, non-exclusive, non-transferable, non-sublicensable, perpetual license to install and use the Software for your personal or internal business purposes.

Dartform is offered as a single one-time purchase: Lifetime Access, currently priced at $59. There is no recurring payment — once purchased, your license does not expire.

• —Your license is tied to the email address used at the time of purchase and is intended for use by a single individual.
• —Licenses are non-transferable and may not be resold or sublicensed.
• —Your license includes all future updates to the Software at no additional cost.
• —Optional paid add-ons (such as Dartform AI, once available) are licensed separately and are not included in the base purchase.

You agree not to, and will not permit others to:

• ✕Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software.
• ✕Modify, adapt, translate, or create derivative works based on the Software.
• ✕Rent, lease, loan, resell, sublicense, or otherwise transfer the Software or your license to any third party.
• ✕Use the Software to build a product or service that competes directly with Dartform.
• ✕Remove, alter, or obscure any proprietary notices, labels, or marks in the Software.
• ✕Use the Software in any manner that violates applicable laws or regulations.
• ✕Circumvent, disable, or interfere with license validation or any security features of the Software.
• ✕Submit harmful, abusive, hateful, or illegal content to Dartform AI.
• ✕Attempt to circumvent Dartform AI usage limits or exploit the feature in a manner inconsistent with its intended purpose.
• ✕Use Dartform AI to generate content unrelated to legitimate software project development.

Once available, Dartform AI will be an AI-powered backend scaffolding feature that generates Serverpod data model scaffolds from plain English project descriptions, licensed separately from the base Software.

• —Dartform AI will process your project description via a secure cloud API. By using Dartform AI you will be consenting to your description being transmitted to and processed by our AI inference provider.
• —Project descriptions submitted to Dartform AI will be stored on our servers for up to 12 months for abuse monitoring and service improvement purposes. They will not be used to train any AI model.
• —Dartform AI output will be provided as a starting scaffold only. You will be responsible for reviewing, validating, and testing all generated code and data models before use in production.
• —We will not guarantee the accuracy, completeness, or fitness for purpose of any output generated by Dartform AI.
• —We reserve the right to suspend or permanently revoke a user's access to Dartform AI at any time, without notice or refund, if we determine the feature is being used in violation of these Terms or in an abusive, harmful, or exploitative manner.

Dartform collects minimal data necessary to operate license validation, authentication, and (once available) its AI add-on. We do not sell your personal data to third parties.

• —Authentication data: Your email address is used for magic-link sign-in via Supabase. We store session tokens to maintain your login state.
• —Purchase data: Purchase records (email, license status) are stored to validate your access to the Software.
• —Project data: Your Serverpod or Dart Frog project files are processed locally on your machine. We do not upload, access, or store your project source code.
• —AI request data: If and when you use Dartform AI (once available), the project description you submit will be transmitted to our AI inference provider for processing and stored on our servers for up to 12 months. It will not be used to train any AI model.
• —Analytics: We may collect anonymized, aggregated usage analytics (feature interactions, error rates) to improve the Software. No personally identifiable information is included.

Dartform is sold as a one-time purchase, processed via Gumroad. By completing a purchase you agree to Gumroad's terms of service in addition to these Terms.

• —All prices are listed in USD. Applicable taxes may be added at checkout depending on your jurisdiction.
• —Refunds may be requested within 7 days of purchase if the Software isn't working for you.
• —Refund requests must be submitted to mobterest@gmail.com with your order ID and reason.
• —Upon a refund, your license is immediately deactivated and access to the Software ends.
• —We reserve the right to change the price of the Software for future purchases at any time. Price changes do not affect purchases already completed.

The Software, including its code, design, visual assets, branding, and documentation, is and remains the exclusive intellectual property of Mobterest Studio. These Terms do not grant you any ownership rights in the Software.

The Dartform name, logo, and associated marks are trademarks of Mobterest Studio. You may not use them without prior written permission.

Dartform is an independent product developed and published by Mobterest Studio. It is not affiliated with, endorsed by, or sponsored by the Serverpod or Dart Frog projects or their maintainers. The Serverpod and Dart Frog names are used solely to describe the software categories Dartform is designed to work with.

Data models and backend scaffolds generated by Dartform AI are based on your input and are provided for your use. Mobterest Studio makes no claim of ownership over output generated from your project descriptions.

The Software is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Software will be error-free, uninterrupted, or free from harmful components, or that defects will be corrected. Use of the Software is at your own risk.

Dartform AI output is generated by an AI model and may contain errors, omissions, or inaccuracies. We make no warranty that AI-generated scaffolds are correct, complete, or suitable for any particular use. You assume full responsibility for reviewing and validating all AI output before use.

To the fullest extent permitted by applicable law, Mobterest Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising out of or related to your use or inability to use the Software, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the total amount you paid for the Software.

These Terms remain in effect until terminated. Your rights under these Terms will terminate automatically, without notice, if you fail to comply with any provision.

Upon termination, you must cease all use of the Software and delete all copies in your possession. Sections 8 (Intellectual Property), 9 (Disclaimer), 10 (Limitation of Liability), and 12 (Governing Law) survive any termination.

We reserve the right to suspend or revoke any license found to be in violation of these Terms without refund. This includes but is not limited to misuse of Dartform AI (once available) or submission of harmful content through the AI feature.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of Kenya.
