Terms of Use

By downloading, installing, or using Dartform (the "Software"), you agree to be bound by these Terms of Use ("Terms"). If you are accepting on behalf of a company or organization, you represent that you have the authority to bind that entity.

If you do not agree to these Terms, do not install or use the Software. Continued use of the Software after any update to these Terms constitutes your acceptance of the revised Terms.

Subject to your compliance with these Terms and maintenance of an active subscription, Mobterest Studio grants you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the Software for your personal or internal business purposes.

Dartform is offered under a single plan: Standard available on Monthly ($7/month) and Annual ($79/year) billing cycles, both inclusive of a 7-day free trial.

• —Each seat is tied to a verified email address and may only be used by one individual at a time.
• —The subscription owner (seat admin) may invite, revoke, and manage teammates via the Seat Management panel.
• —Subscriptions are non-transferable and may not be resold or sublicensed.
• —Access to the Software is contingent on maintaining an active subscription. Upon cancellation or non-payment, access will be suspended at the end of the current billing period.

You agree not to, and will not permit others to:

• ✕Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software.
• ✕Modify, adapt, translate, or create derivative works based on the Software.
• ✕Rent, lease, loan, resell, sublicense, or otherwise transfer the Software or your subscription to any third party.
• ✕Use the Software to build a product or service that competes directly with Dartform.
• ✕Remove, alter, or obscure any proprietary notices, labels, or marks in the Software.
• ✕Use the Software in any manner that violates applicable laws or regulations.
• ✕Share invite tokens or seat credentials with unauthorized individuals.
• ✕Circumvent, disable, or interfere with license validation or any security features of the Software.
• ✕Submit harmful, abusive, hateful, or illegal content to Dartform AI.
• ✕Attempt to circumvent Dartform AI usage limits or exploit the feature in a manner inconsistent with its intended purpose.
• ✕Use Dartform AI to generate content unrelated to legitimate software project development.

Dartform AI is an AI-powered backend scaffolding feature available to subscribers with an active subscription. It allows users to generate Serverpod data model scaffolds from plain English project descriptions.

• —Dartform AI is included in all active subscriptions at a rate of 5 scaffold requests per month. This allowance resets on next billing month.
• —Dartform AI processes your project description via a secure cloud API. By using Dartform AI you consent to your description being transmitted to and processed by our AI inference provider.
• —Project descriptions submitted to Dartform AI are stored on our servers for up to 12 months for abuse monitoring and service improvement purposes. They are not used to train any AI model.
• —Dartform AI output is provided as a starting scaffold only. You are responsible for reviewing, validating, and testing all generated code and data models before use in production.
• —We do not guarantee the accuracy, completeness, or fitness for purpose of any output generated by Dartform AI.
• —We reserve the right to suspend or permanently revoke a user's access to Dartform AI at any time, without notice or refund, if we determine the feature is being used in violation of these Terms or in an abusive, harmful, or exploitative manner.
• —Dartform AI scaffold limits may be updated from time to time. We will provide reasonable notice of any reduction in the monthly allowance.

Dartform collects minimal data necessary to operate its subscription, authentication, and AI features. We do not sell your personal data to third parties.

• —Authentication data: Your email address is used for magic-link sign-in via Supabase. We store session tokens to maintain your login state.
• —Subscription data: Purchase records (email, plan type, seat count, billing status) are stored to validate and manage your subscription.
• —Project data: Your Serverpod project files are processed locally on your machine. We do not upload, access, or store your project source code.
• —AI request data: When you use Dartform AI, the project description you submit is transmitted to our AI inference provider (Groq) for processing and stored on our servers for up to 12 months. It is not used to train any AI model.
• —Analytics: We may collect anonymized, aggregated usage analytics (feature interactions, error rates) to improve the Software. No personally identifiable information is included.

Dartform subscriptions are processed via Gumroad. By completing a subscription you agree to Gumroad's terms of service in addition to these Terms.

• —All prices are listed in USD. Applicable taxes may be added at checkout depending on your jurisdiction.
• —7-day free trial is available on both the Monthly and Annual plans. Your payment method will not be charged until the trial period ends.
• —You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, you retain full access until then.
• —Subscriptions renew automatically unless cancelled before the renewal date.
• —Refunds may be requested within 7 days of a charge, provided it is your first refund request and there is no evidence of subscription abuse.
• —Refund requests must be submitted to mobterest@gmail.com with your order ID and reason.
• —No refunds will be issued for partial billing periods or for trial periods that were not cancelled before the trial ended.
• —Upon a refund, all seats under the subscription will be immediately deactivated, including any active teammate seats.
• —We reserve the right to modify pricing with at least 30 days' notice. Price changes will not affect the current billing period.

The Software, including its code, design, visual assets, branding, and documentation, is and remains the exclusive intellectual property of Mobterest Studio. These Terms do not grant you any ownership rights in the Software.

The Dartform name, logo, and associated marks are trademarks of Mobterest Studio. You may not use them without prior written permission.

Dartform is an independent product developed and published by Mobterest Studio. It is not affiliated with, endorsed by, or sponsored by the Serverpod project or its maintainers. The Serverpod name is used solely to describe the software category Dartform is designed to work with.

Data models and backend scaffolds generated by Dartform AI are based on your input and are provided for your use. Mobterest Studio makes no claim of ownership over output generated from your project descriptions.

The Software is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Software will be error-free, uninterrupted, or free from harmful components, or that defects will be corrected. Use of the Software is at your own risk.

Dartform AI output is generated by an AI model and may contain errors, omissions, or inaccuracies. We make no warranty that AI-generated scaffolds are correct, complete, or suitable for any particular use. You assume full responsibility for reviewing and validating all AI output before use.

To the fullest extent permitted by applicable law, Mobterest Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising out of or related to your use or inability to use the Software, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the total subscription fees you paid in the twelve (12) months preceding the claim.

These Terms remain in effect until terminated. Your rights under these Terms will terminate automatically, without notice, if you fail to comply with any provision.

Upon termination, you must cease all use of the Software and delete all copies in your possession. Sections 8 (Intellectual Property), 9 (Disclaimer), 10 (Limitation of Liability), and 12 (Governing Law) survive any termination.

We reserve the right to suspend or revoke any subscription found to be in violation of these Terms without refund. This includes but is not limited to misuse of Dartform AI, abuse of scaffold limits, or submission of harmful content through the AI feature.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of Kenya.
